Terms of Sale


I. CONCLUSION OF THE ONLINE CONTRACT
The customer must follow a series of steps specific to each product offered by the seller in order to complete the order. However, the steps described below are systematic:

  • Information on the essential characteristics of the product.
  • Selection of the product and, if applicable, its options, and indication of the customer’s essential data (identification, address, etc.).
  • Acceptance of these General Terms and Conditions of Sale.
  • Verification of order details and correction of any errors.
  • Follow-up of payment instructions and payment of products.
  • Delivery of products. The customer will then receive confirmation by e-mail of payment for the order, as well as an acknowledgement of receipt of the order confirming it. For delivered products, delivery will be made to the address indicated by the customer. In order for the order to be processed correctly, and in accordance with article 1316-1 of the French Civil Code, the customer undertakes to provide truthful identification details. The seller reserves the right to refuse the order, for example in the event of any abnormal request, made in bad faith or for any legitimate reason (non-treatment of abusive orders). L111-1, L111-2 of the French Consumer Code).


II. PRICES
The prices of products sold through the website are indicated in euros, all taxes included (association exempt from commercial taxes. TVA non applicable, article 293 B du CGI.) on the product order page, and exclude specific shipping costs. The price of our books complies with French law Lang 81-766 of August 10, 1981 on the single price of books. For all products shipped outside the European Union and/or French overseas departments and territories, the price is automatically calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable in certain cases. These rights and sums are not the responsibility of the seller. They are the responsibility of the buyer (declarations, payment to the relevant authorities, etc.). In this respect, the seller invites the buyer to obtain information on these aspects from the relevant local authorities. The association reserves the right to modify its prices at any time in the future. Telecommunication costs for access to the association’s website are at the customer’s expense. Delivery charges may also apply.


III. METHOD OF PAYMENT
Orders can be paid via the PayPal secure payment system.

IV. AVAILABILITY AND PRESENTATION

  • Orders will be processed while stocks last. If an item is unavailable for more than fifteen working days, the customer will be informed immediately of the expected delivery times and the order for this item may be cancelled on request. The customer may then request a credit note for the amount of the article or a refund.
  • Certain out-of-print items remain visible on the website in order to constitute a reference catalog of published titles. These are clearly marked “unavailable” and cannot be ordered.


V. WARRANTIES
In accordance with the law, the seller assumes two warranties:

  • Conformity,
  • Relative to hidden product defects. The seller will reimburse the purchaser or exchange products that appear to be defective or do not correspond to the order placed. Requests for refunds must be made by e-mail and supported by as many details as possible (photo of the item, proof of purchase, etc.). The seller reminds that the consumer :
  • Has a period of 2 years from delivery of the goods to take action against the seller.
  • May choose to replace the apparently defective or non-corresponding item, subject to the conditions set out in the aforementioned provisions.
  • The customer is exempted from having to prove the existence of a lack of conformity for 6 months following delivery.
  • That, except for used goods, this period has been extended to 24 months as of March 18, 2016.
  • That the consumer may also invoke the warranty against latent defects of the thing sold within the meaning of article 1641 of the Civil Code and, in this case, may choose between rescission of the sale or a reduction in the sale price [provisions of articles 1644 of the Civil Code]. CLAIMS If necessary, the purchaser may make any claim by contacting the association at the following address: boutique@credac.fr. Please state clearly the purpose of your complaint.


VI. DELIVERY

  • Shipping costs are calculated according to the weight of the order.
  • As soon as payment is received, the order will be dispatched within two to three working days, by letter or tracked parcel service (delivery generally takes between 24 and 72 hours for France, with more variable delivery times for the rest of the world, depending on the specific characteristics of the country).
  • The association takes particular care with packaging to ensure that items ordered arrive in the exact condition in which they were purchased.


VII. RETURNS AND WITHDRAWAL PERIOD
In accordance with article L. 121-20 of the French Consumer Code: “The consumer has a period of 14 clear days to exercise his right of withdrawal without having to justify his reasons or pay any penalties, with the exception, where applicable, of the cost of returning the goods”; “The period mentioned in the previous paragraph runs from the date of receipt for goods or acceptance of the offer for services”. Returns are accepted and the right of withdrawal may be exercised up to the 14th day after receipt of the parcel at the purchaser’s address by contacting the association as follows: contact by e-mail, specifying the subject of the request. If the right of withdrawal is exercised within the aforementioned period, only the price of the product(s) purchased and the cost of shipping will be reimbursed; the cost of returning the product(s) remains the responsibility of the purchaser. Products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) so that they can be remarketed in new condition. If possible, they should be accompanied by a copy of the purchase receipt. Refund procedure: by bank transfer or cheque.


VIII. ACCEPTANCE BY THE PURCHASER
These General Terms and Conditions of Sale and the price list are expressly approved and accepted by the purchaser, who declares and acknowledges full knowledge thereof. The purchaser hereby waives the right to invoke any contradictory document, in particular his own General Terms and Conditions of Purchase: the act of purchasing implies acceptance of these General Terms and Conditions of Sale. These conditions may be modified at any time without prior notice.


IX. APPLICABLE LAW
All clauses contained in the present General Terms and Conditions of Sale, as well as all purchase and sale transactions referred to herein, are subject to French law.
